These Terms of Service (the "Terms") govern your use of the web service "SimoAI / 惜墨AI" (the "Service") provided by SimoAI ("we", "us", or "our"). By accessing or using the Service, you ("User") agree to be bound by these Terms.
The English version is provided for convenience only. In the event of any discrepancy between the English and Japanese versions, the Japanese version shall prevail as the legally binding text.
Article 1 (Scope)
These Terms apply to all relationships between the User and us regarding the use of the Service. Any individual provisions posted on our website shall form an integral part of these Terms.
Article 2 (Registration)
- Any person wishing to use the Service shall complete registration by providing the required information (including a valid email address) through the method we specify.
- We may refuse registration without disclosing any reason if we determine that the applicant:
- has provided false information;
- has previously been suspended from the Service for violating these Terms;
- is otherwise deemed unsuitable for registration at our discretion.
Article 3 (Account and Password Management)
The User is solely responsible for managing their Service account and password. We shall not be liable for any damages arising from inadequate management, incorrect use, or unauthorized third-party use of the account.
Article 4 (Fees and Credits)
- Paid features of the Service are available through the purchase of prepaid credits. Credit prices and amounts are as displayed on the pricing page.
- Payments are processed via the Stripe payment system.
- Refunds of purchased credits are governed by the Refund Policy. Due to the nature of digital content, refunds are generally not available.
- Unless otherwise specified, credits have no expiration date, but will be forfeited upon account deletion or termination of the Service.
Article 5 (Prohibited Conduct)
The User shall not engage in the following conduct when using the Service:
- Acts that violate laws, regulations, or public order and morals;
- Acts related to criminal activity;
- Infringement of copyrights, trademarks, or other intellectual property rights of the Service or its contents;
- Infringement of the rights or interests of us, other users, or third parties;
- Commercial use of information obtained through the Service (excluding AI-generated content);
- Any acts that interfere with the operation of the Service;
- Unauthorized access or attempts at unauthorized access;
- Scraping, reverse engineering, or using the Service for the development of competing services;
- Using content generated through the Service for academic misconduct (plagiarism, ghostwriting, etc.);
- Any other conduct we deem inappropriate.
Article 6 (AI-Generated Content)
- The Service uses AI technology to generate documents and text ("Generated Content"). Generated Content is based on User inputs, and we do not warrant its accuracy, completeness, originality, or fitness for any particular purpose.
- When using Generated Content for study abroad applications, academic documents, or other important purposes, the User is responsible for reviewing and editing the content themselves.
- To the maximum extent permitted by applicable law, copyright in Generated Content belongs to the User who directed its generation. However, the User acknowledges that identical or similar output may be generated for other users.
Article 7 (Suspension of Service)
We may suspend or interrupt all or part of the Service without prior notice to the User if any of the following conditions applies:
- Maintenance or updates of the Service systems;
- Force majeure events such as earthquakes, lightning, fire, power outages, or natural disasters;
- Computer or communication line failures;
- Unavailability of third-party services such as AI providers;
- Any other cases where we determine that provision is difficult.
Article 8 (Disclaimer of Warranties and Limitation of Liability)
- We do not warrant, expressly or impliedly, that the Service is free from defects in fact or law (including safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, absence of errors or bugs, or non-infringement).
- Except in cases of our willful misconduct or gross negligence, we shall not be liable for any damages arising from the Service.
- Even in such cases, our total liability shall be limited to the amount paid by the User to us during the preceding 12 months.
Article 9 (Changes to the Service)
We may change or discontinue the Service without notice to the User, and shall not be liable for any damages resulting from such changes.
Article 10 (Changes to the Terms)
We may modify these Terms without prior notice when we deem it necessary. The modified Terms shall take effect upon being posted on this page. Continued use of the Service after such modifications shall be deemed acceptance of the modified Terms.
Article 11 (Handling of Personal Information)
Personal information obtained through the use of the Service shall be handled in accordance with our Privacy Policy.
Article 12 (Governing Law and Jurisdiction)
- These Terms shall be governed by and construed in accordance with the laws of Japan.
- The Tokyo District Court shall have exclusive jurisdiction as the court of first instance over any disputes arising in connection with the Service.
